The House of Lords today handed down judgement in R v Islam; Mark Sutherland Williams and Charlotte Hadfield of the AFG at 3PB appeared at junior counsel for the Crown.
The case, which focused on whether the Court of Appeal had been correct in determining that illicit drugs had no market value, was concluded with a 3-2 judgement from the House of Lords in favour of the RCPO's argument that illicit drugs did have a market value and that for the purposes of calculating the benefit figure in confiscation proceedings, that market value should be recognised. This success reflects the continued progress of the AFG at 3PB, and represents its third case in the House of Lords in as many years in which members of the AFG have appeared.
