Andrew has acted for both Claimant and Defendant in defamation claims. Recently, he acted for the Claimants in Beach Developments Limited v. Foskett [2011] EWHC 198 (QB), a dispute that ran for more than 3 years, involving principally issues of justification and fair, or honest, comment in respect of material posted on an internet forum. The claim was settled on terms favourable to the Claimants following a preliminary hearing before Tugendhat J just weeks before trial.
He also recently acted for the Defendants in the conjoined cases of Eayrs v. Stubbs and Eayrs v. Southampton Voluntary Services which concerned material, including a letter to a local member of parliament, published following a meeting within a charitable organisation. The claim raised a wide range of allegations, and was defended on an equally broad front, including qualified privilege. Andrew appeared for both Defendants on an interim application when both claims were struck out.
