Barry Stancombe’s practice covers an extensive range of disciplines within the areas of Business and Commercial Law. He is instructed to provide advisory and advocacy expertise on business and commercial law disputes, on behalf of large corporations through to private individuals. Barry’s practice also encompasses the complementary areas of civil fraud and asset forfeiture.

The areas of business and commercial work/litigation in which he has been involved are as follows:

• obtaining a freezing injunction on behalf of a company following the theft of substantial funds by an accounts employee
• a claim against a defendant employee in an action for breach of confidence; breaches of express/implied terms of her contract of employment;
• a dispute over the breakdown of a distribution agreement; 
• acting for an employer in an intellectual property/breach of confidentiality dispute with a former employee; 
• sale of goods disputes; 
• acting in proceedings against a professional football club by shirt suppliers/sponsors.
• a commission claim by a senior employee against his employer for substantial sums; 
• acting for the purchaser of a Spanish villa defending claims brought by the spouse and Trustee in Bankruptcy of the vendor;
• defending a minority shareholder claim in relation to a large wheel and tyre supplier;
• settling directors service contracts;
• agent’s commission claims;
• acting for the Attorney General of the Turks & Caicos Government in civil proceedings. 

Notable Cases

Barnes v Gilmartin Associates NLP 29.07.98 EAT -
Unfair dismissal redundancy-requirement for part-time work displaced by requirement for full-time worker-what constituted work of a particular kind.

Emery v UCB Bank Plc 15.05.97 CA -
Successful appeal against strike out order resulting in the reinstatement of the claim concerning the misconduct of a receivership of a nursing home. Instructed in CA only.

National Bank of Abu Dhabi v Mohammed & Others NLP 21.03.97 CA -
Appeal from deputy judge of the Chancery Division. Undue influence alleged by wife of debtor. Represented the Bank in successfully dismissing the claims/the appeal.

Ord v Belhaven Pubs Limited NLP 13.02.98 CA -
Appeal from Judge in Chambers. Judge wrong to substitute the Defendant following the commercial re-structuring of the Belhaven group of companies. Plaintiff not entitled to lift the corporate veil so as to permit substitution.

Timothy John Hargreaves (Trustee in Bankruptcy of Salt) v Salt & Hill [2010] EWHC 3549 Fam -
Claim by Trustee re alleged sale of Spanish property at an undervalue/claim by spouse to set aside property sale.

Treadwell v Dawkins TLR/NLP 24.05.00 QBD -
Company Director held personally liable for fraudulent misrepresentation as to the availability of finance for building development.
