Employment

Barry Stancombe advises on all aspects of employment law. He has acted in employment cases for many years representing both Claimants and Respondents and is a member of the Employment Law Bar Association.

Barry Stancombe is instructed in all types of cases in Employment Tribunals in England and Wales. Such cases range from representing former BMI pilots in a TUPE dispute to representing a former employee of the Post Office in an unfair dismissal disability/sex discrimination claim.

As an experienced civil litigator Barry Stancombe tends to receive instructions in complex and lengthy cases in Employment Tribunals. He has a strong case management approach to such cases and is comfortable in dealing with factually complex/document heavy cases.

Other recent employment matters include: acting for former employees of sea ferry business in relation to a TUPE transfer; a case which concerned the status of an "agent" and whether he was an employee; advising a company on redundancy procedures; representing an employee in an unfair dismissal/redundancy, disability/sex discrimination claim; and advising company directors following the termination of their service contracts.

He is instructed regularly in the High Court in restrictive covenant injunction cases acting for both Claimants and Defendants. Such cases involve the enforcement of express and/or implied terms of employment as well as database rights under the Database Regulations 1997.

Barry has years of experience of mediation in commercial matters and has been involved over the last few years in substantial mediations involving employment cases.

He will attend conferences out of Chambers and adopts an approach of advising professional clients as and when they require the advice. His hourly rates can be obtained from the 3PB Clerks.
