Hala has prosecuted and defended in a wide range of ‘regulatory’ offences in both the magistrates’ and crown court, including:
- Local authority prosecutions (planning and tree preservation orders, trading standards)
- Health and Safety - successfully defended shop owner in local authority H&S prosecution charged with selling knives to underage customers involving issues of evidence obtained by undercover operations conducted by the local authority.
- Environment Agency prosecutions (pollution)
- DVLA prosecutions (vehicle excise duty offences)
- Vehicle offences
- Marine offences
- Animal offences (in particular under the Dangerous Dogs Act 1991 and the Animal Welfare Act 2006)
Hala has a niche practice involving a wide-range of driving offences, including driving without due care and attention, driving while under the influence of alcohol or drugs, driving without insurance, and driving while disqualified.
Examples of other work undertaken within the Public Law and Regulatory Group:
- Seconded to Field Fisher Waterhouse LLP, working as part of a team instructed by the Nursing and Midwifery Council (‘the NMC’) to consider potential cases to be heard by the NMC, draft advisory reports on evidence and on the existence of a case to answer, and to draft charges
- Condemnation appeals against HMRC – acting for both appellant and HMRC
- Licensing – appeals against the revocation of taxi drivers’ licences, acting on behalf of local authorities and taxi drivers
- Alcohol licensing for public houses, nightclubs, and events
- Special treatments licensing for beauty and health establishments
- Representation before the Disciplinary Panel of the Royal Institution of Chartered Surveyors
