Public Law & Regulatory

Public Law

Harriet has been involved in a wide range of public law work and JR proceedings. She also has in-house experience of working for a public body, having been employed as a Legal Adviser at Ofcom, and having assisted the legal team at Ofgem on a short-term basis.

Reported public law cases in which Harriet was involved as a pupil are as follows; she also assisted in the provision of advice and preparation of pleadings in many further cases:

  • Nokia Corporation v Her Majesty’s Commissions of Revenue and Customs [2009] All ER (D) 341 (Jul)
  • R (Saunders) v IPCC [2009] 1 All ER 379
  • SRM Global Master Fund LP v Commissioners of Her Majesty’s Treasury [2009] EWCA Civ 788, [2010] BCC 558 (Northern Rock shareholders’ appeal to the Court of Appeal)
  • R (Bristol-Myers Squibb Pharmaceuticals Ltd) v National Institute for Health and Clinical Excellence [2009] EWHC 2722 (Admin), [2010] 1 CMLR 926.

Sports

A number of Harriet’s pupil supervisors, including Louis Weston at 3PB, practise in sports law, and whilst working with them she has undertaken the following:

  • Preparing for and attending a hearing before the Sports Dispute Resolution Panel relating to the disciplining of a show jumper.
  • Drafting a pre-action response letter for a sports governing body.
  • Advising on competition law in a sports context.
  • Drafting an initial defence in a case concerning fiduciary duties of football agents.
  • Preparing initial advices in relation to British Board of Boxing Control boxer/manager agreements and regulations.
  • Considering potential quantum of damages in a claim for professional negligence against a vet in relation to a racehorse.
  • Research in advance of a hearing before the Court of Arbitration for Sport in Lausanne concerning a nationality issue.

Police law

Harriet has an interest in police law, and since joining 3PB has already been instructed in relation to a civil action against the police.

Financial and Professional Regulatory

As a pupil Harriet assisted in many cases concerning financial regulatory issues, including rare proceedings brought by the Panel on Takeovers and Mergers. She assisted in preparing for, and then attended, hearings before the Regulatory Decisions Committee of the FSA and the Financial Services and Markets Tribunal. She also assisted in preparing for LSE/AIM disciplinary proceedings, and advising in the context of FSCS compensation.

Harriet will also take instructions in other professional regulatory matters, and in summer 2011 spent a month on secondment to the Public & Regulatory Group of Field Fisher Waterhouse LLP to review investigations carried out by them on behalf of the Nursing & Midwifery Council into allegations of incompetence and misconduct by its registrant members.
