Having a substantial commercial and insolvency practice James is well placed to both advise on and to act in asset forfeiture/ recovery matters. His leading cases in this area include CPS v Compton [2002] EWCA Civ 1720 which involved consideration of issues including piercing the corporate veil and conflict of ownership claims between a Trustee in Bankruptcy, the CPS and the spouse of a Defendant against whom a confiscation order had been made.
His expertise extends into areas such as the equitable tracing of assets and breach of trust claims.
