Richard is instructed within a variety of Business and Commercial Law based disputes to provide both advisory and advocacy expertise. His experience gained in both the public service (NHS) and financial industries (Financial Ombudsman) prior to coming to the bar enable Richard to approach disputes from a commercial as well as a legal viewpoint. This experience also allows Richard to bring a team work ethic and flexibility, assisting in guiding clients to achieving resolution of their disputes.
Richard is an accomplished advocate with a style which belies his year of call; this was gained by undertaking criminal cases whilst he was a pupil.
Richard is willing to consider cases on a CFA basis where appropriate.
Attending a pre-action site meeting, and subsequently advising, in a construction contract dispute (as to quality of workmanship);
Advising on the applicability of VAT zero-rating to listed building works;
Conducting and advising on a number of insolvency and winding-up cases, including applications to set aside statutory demands;
Advising and drafting in a dispute as to the enforceability of a guarantee both generally and under the Consumer Credit Act.
Advising and drafting in a dispute regarding variation of a contract, particularly as to permanence and equitable forbearance.
Richard also has experience both prior to joining chambers and during his pupillage of consumer protection law, particularly the Consumer Credit Act and associated regulations.
